The principal means of production, distribution and exchange in the capitalism market are in the private hands. Thus the capitalist system is really emphasised on the ownership of private property. The owner of the private property has the right of control, claim on the usufruct of a property, right to exclusivity and right to transfer ownership.
In Islamic market, absolute ownership belongs to Allah and Men are the trustee. However, Islam does not prohibit private property ownership as long as the ownership is permissible which the transaction is halal and legal, the property is properly and constantly utilize, and also help human to meet the obligation in Islam such as pilgrimage. As for the public property, it is fully under the authority of the state and the state has the right to nationalize or privatize it based on the public interest. In order to own a property, three elements which are object, subject and contract must be fulfilled.
